摘　　要：伴随北京、上海等国际化大都市的出现、增多和整个国家国际化进程的加快,中国境内的外国人口激增,中国开始面临长期困扰西方发达国家的外国人犯罪问题。文章在分析北京地区近10年外国人犯罪的规律和趋势的基础上,着力思考如何解决城市、国家的国际化发展与外国人犯罪应对体系滞后的现实问题,如何构建与城市、国家的国际化程度相适应的外国人犯罪刑事政策,如何设置顺应国际人口流动的出入境犯罪罪名体系,如何在全球化趋势下扩张中国刑法的适用范围、强化属地管辖意识和增强国际刑事司法协作,从而尝试为应对中国境内国际化大都市的逐渐增多和整个国家国际化程度的日益提高而做好法律层面的准备提供学理支持。With the emergence of Beijing,Shanghai and other international metropolises,the increasing internationalization of China and the rapid growth in the number of foreigners in the country,China is now facing a problem that has long harassed the developed West:the problem of crimes committed by foreigners.Based on an analysis of trends in crimes committed by foreigners in Beijing over the last decade and the laws relating to them,this study addresses practical issues including the lagged response to such crimes in the context of urban and national internationalization;the development of criminal policies that are consistent with urban and national internationalization;the establishment of a system of exit/entry criminal charges that is congruent with international population migration;and increasing the applicability of Chinese criminal law,raising awareness of territorial jurisdiction and strengthening international cooperation in criminal justice in the context of globalization,so as to make legal preparations for China's burgeoning international cities and its ever increasing internationalization.
