大陆台资企业用工现状与台商权益保护

摘　　要：《海峡两岸经济合作框架协议》(ECFA)的实施使两岸经贸合作进入一个新的阶段,也对立法保护台商权益提出了新的要求。劳动力优势是大陆台资企业迅速发展的重要支柱,但台资企业在用工过程中也存在着许多问题,造成了企业与劳动者之间矛盾的激化。因此,完善台商权益保护的各项制度,特别是在规范用工制度方面进行有益的探索和实践,对于保护台商在大陆投资、维护台商及劳动者的合法权益、促进两岸关系和平发展具有重要意义。The economic cooperation between China's Mainland and Taiwan has entered into a new phrase since the formation of Economic Cooperation Framework Agreement . The new development in the economic cooperation has raised issues about the protection of Taiwan - funded enterprise＇ s interests. Cheap labor used to be a significant factor in the fast development of Taiwan- funded enterprises in China's Mainland. Nevertheless, there have been many problems in the relationship be- tween employers and employees in Taiwan -funded enterprises in China's Mainland. And the relationship has been intensi- fied recently. Therefore, the further improvement of various mechanisms in protecting Taiwan - funded enterprise＇ s inter- ests, in particular the perfection of employment law would be significant in protecting Taiwan - funded enterprise＇ s interests and employeeg legal interests and improving the relationship between China's Mainland and Taiwan.
