雷公山地区苗族婚姻习惯法与刑法冲突现象分析

摘　　要：黔东南雷公山地区一些苗族聚居地方的婚姻习惯法能够独立形成体系,但是其中的很多规范与国家法严重冲突,有些规范内容甚至与国家刑事法律规范冲突,主要表现为反抢婚制度与暴力干涉婚姻自由罪的冲突,早婚制度与奸淫幼女罪的冲突以及离婚制度与重婚罪的冲突等内容。In the Leigong Mountain area of Qiandongnan, Guizhou Province, some Miao people can develop their unaided system about the marriage customary law, while some regulations have a serious conflict with constitutional law. What＇ s worse, some even have a serious conflict with criminal law in our country, such as the conflict between reverse marriage by capture and interference with the free- dom of marriage by force ; early marriage and crime of having sexual intercourse with a minor; and di- vorce system and bigamy marriage and so on.
