摘　　要：学术评议会是发达国家大学治理结构中体现和保障学术权力最为重要的组织机构,发达国家普遍通过立法明确了大学学术评议会的法律地位、人员构成和职责范围,以保障学术权力的全面履行。德国的现代大学制度在西方大学发展过程中具有承前启后的意义。笔者重点分析了德国联邦与州的相关法律法规,并通过柏林工业大学的案例考察学术评议会运行状况;在此基础上,提出了完善我国的大学学术委员会制度,保障学术权力全面落实的若干借鉴。In developed countries, academic senate is the most important organization embodied in university governance structure to reflect and guarantee the academic power. Developed countries legitimatize the status, personnel and duties of university academic senate by establishing legal provisions so as to guarantee the academic power is comprehensively fulfilled. Having realized that modern university system of Germany plays a significant role in western universities development, this article particularly analyses Germany＇s relative federal and state legal provisions and regulations and specifically evaluates the operation of academic senate by taking Technischen Universitat Berlin （TUB） as an example. On the basis of TUB, this article further puts forward suggestions and references on the systematic improvement of academic committee and the full implement of academic power that suit for Chinese university.
