摘  要:农村产权抵押融资的出现,可视为一种新的制度产生,也是制度变迁的主体内化外部利润的结果。农村产权抵押融资制度生成的外部利润主要包括:抵押权实现后的收益及其分享、节约的交易费用。农村产权抵押融资的制度安排满足了农民、金融机构、地方政府的利益需求,符合同意一致性原则,是一种新的帕累托改进。同时农村产权抵押融资的法律风险、城乡土地制度以及城乡社会保障制度的二元性等约束条件的存在,导致效率的损失。要推进农村产权抵押融资的发展,必须增加其外部利润,减少效率损失。The article applies new systematic economics to analyze the causes and constraints of institutional changes of rural assets mortgage rules. The appearance of rural assets mortgage rules can be considered as the generation of a new system,the result of internalization of external profit from the main body of institutional change. The external profit of rural assets mortgage rules mainly consists of the income and distribution of the realization of mortgage rights and the lower transaction cost. Meeting the interest demand of the peasants, money corporation and local government,the institutional arrangement of rural assets mortgage rules is a new Pareto improvement, being in conformity with the principle of common consent. Besides, the rural assets mortgage rules are still faced with some constraint conditions, such as legal risk of rural assets mortgage rules, the duality of land system and social guarantee system in urban and rural areas,which will result in some loss in efficiency. To push the development of rural assets mortgage rules, we must increase external profit and decrease efficiency loss.
