生物燃料补贴法律问题探析

摘　　要：以生物燃料的生产、经营链为主线,结合协调制度(HS),根据《农业协定》和《补贴与反补贴协定》等相关法律法规,将生物燃料补贴分为使用《农业协定》的补贴和《补贴与反补贴协定》的补贴两类,并分析不同种类生物燃料补贴与相应法律法规之间的关系。同时,由于WTO构建的补贴体系缺乏对生物燃料补贴的明确规定,直接影响了对生物燃料补贴的有效规制。This paper mainly based on the biofuel production and management and combined with the HS and the Agreement on Subsidies and Countervailing Measures and the Agreement on Agricultural to clas- sify the biofuel subsidies into two types, one is to apply to Agreement on Subsidies and Countervailing Measures and the other is Agreement on Agricultural, and analyses the relationship of the different types with the relevant law. But because the system of the WTO subsidy is short of the definite provision about biofuel subsidies, which directly affects the efficiency of the regulations on the biofuel subsidies.
