摘　　要：广州生态文明建设在"十一五"期间取得重要的阶段性成果的同时,存在刚性治理较突出等急需改进的问题。作为环境治理的新模式,环境保护行政合同在生态文明建设中具有独特的作用。在借鉴国内外相关经验的基础上,应加强环境保护行政合同的理论研究与制度建设,通过完善第三人监督、明确环境治理机关的行政优益权、限制环境保护行政机关的单方变更与解除权、完善环境保护行政合同司法审查等具体制度安排推进环境保护行政合同在广州生态文明建设中的适用,The construction of ecological civilization in Guangzhou has made positive progress in the recent times, but in the meantime, there remain such problems as excessive rigidity of governance that need improvement. As a new model of environmental management, administrative contract for environmental protection has its unique effect on the construction of ecological civilization. To forward the application of the administrative contract to the construction of ecological civilization in Guangzhou, the theoretical research and systematic construction of the contract should be enhanced with relevant experiences at home and abroad. To be more specific, third-party monitoring should be promoted, the administrative prior rights of the environmental management authority be clarified, the unilateral right to change and cancel of the environmental protection authority be limited, and the institutional construction with judicial review of the administrative contract for environmental protection be improved.
