摘 要:警察执法时不可避免地享有裁量权,裁量权渊源于社会问题错综复杂和囿于人类理性的有限性。事先通过制定行政规则来规范警察裁量权是一种具有相当优势的措施,警察裁量权之建构实质上是事中程序之治,警察裁量权之制约为事后监控和校正机制,这种制约模式主要有通过警察内部的层级监督和行政申诉,以及来自警察外部的的新闻媒体监督、司法审查和监察专员的制约等。在目前中国警察权的二元结构性语境下,应尽可能地发挥司法审查的制度效应,推进以裁量基准为核心的行政规则建设,应善用媒体监督,确保警察权力合法正当行使。Police enforcement discretion will inevitably have complex roots in social problems and is confined to the limited nature of human reason, by making administrative rules in advance to regulate the police discretion is one kind with advantages of measures. The police is the construction of discretion in essence, and the police for program of discretion is restricted as afterwards monitoring and cor- rection mechanism. This restriction pattern has internal level oversight and administrative appeal, as well as from judicial review and monitoring the restriction of the commissioner. With Chinese police power in the current context of the dual structural ,we should play as much as possible effects of the system of judicial review, discretionary basis to promote the core building of the administrative rules, and make good use of media monitoring to ensure that the legitimate exercise of police power legitimate.
