摘　　要：医疗侵权损害结果和因果关系属于法律事实方面的问题,认定时应使其最大限度反映客观真实。借鉴循证医学方法,完善和改进医疗侵权认定的法律方法,使法律规范与诊疗规范形成良性互动,实现法对医学规律的遵循。本文以前期状况为核心基准,借鉴医患双方提供的医学理论和经验方面的资料,从现行诊疗护理规范、专著和医学文献中选择与前期状况密切相关的内容,用以构建认定损害结果和因果关系的参照标准。以等置模式的理念和方式促成临床医学个性化诊疗与司法个案公平的相互贯通,对医疗损害技术鉴定、医疗侵权审判均有一定的理论和实践意义。The identification of damage results and causation in medical tort, as part of legal fact finding, should reflect the objective reality to the best extent possible. The legal identification of medical tort can be improved using evidence-based medical approaches to form a benign interaction between legal norms and diagnostic and treatment practices for the harmony between legal and medical orders. This study is aimed to establish the reference standard for identifying the damage results and causation with a core basis of the antecedent conditions, taking into account the information of medical theory and experience provided by both doctors and patients as well as the current clinic care norms, publications, and medical literature corresponding to those conditions. The concepts and methods derived from the equalization mode can facilitate the interpenetration between personalized diagnosis and treatment and judicial justice for individual cases, and are of theoretical and practical significance for the technical identification of medical damage and medical tort trials.
