摘　　要：2000年1月31日 ,日本神户地方法院就一起公路汽车尾气污染损害赔偿案作出判决 ,判决国家和公路公团向居住在国道附近的汽车尾气污染的受害者支付巨额赔偿金 ,并令国家和公路公团限制汽车尾气排放。该判决在日本引起强烈反响。它对今后类似案件的判决和公益性极强的建设项目的环境对策的制定都将产生重大影响。Kobe's local court,Japan,entered a judgement on compensation for damages caused by vehicle's gas pollution on january 31,2000. The judgement,which requires nation and highway community to pay a large sum of money for victims of the vehicle's gas pollution who lived near the national highway and nation and highway community to limit the emission of gas,raised intense reaction in Japan. It will bring a magnificent influence on the judgement of future cases and teh legislation of environmental reaction for the constrution program of high public benefit.
