体育法的价值冲突研究

摘　　要：体育法的价值冲突主要包括各价值目标间的冲突、不同价值主体的相互对立以及不同体育法律制度的价值冲突,具体表现在立法、执法、守法过程中自由和秩序、公平和自由、秩序和公平等价值目标间的冲突。造成体育法价值冲突的原因多种多样,其中主体的多元性、认识论中二元对立的机械思维模式、价值论中的一元性与多元性的对立和社会结构各领域对于体育法的需求不同等是主要原因。体育法价值冲突的解决是体育法的价值得以实现的需要,也是体育法不断革新和发展的需要,因此必须在坚持以人为本、相对位阶和多元适用的原则下,解决体育法的价值冲突。The conflict of value of sports law covers mainly the conflict of value targets, mutual opposition of the different value subjects and the value conflict of the different sports legal systems, which incorporates conflict of value targets, such as freedom and order, equity and freedom, and so on in course of lawmaking, execution of the law, abidance. There are many reasons that lead to the conflict of value of sports law, among which the main reasons are pluralism of subject, mechanical thought model of binary opposition in epistemology, unary and multivariate opposition in axiology, different demand on sports law in different social field. Conflict settlement of value of sports law is demand of value realization of sports law and the incessant renovation and development, so we must solve the conflict of value of sports law by sticking to principles of human - oriented, relative rank and multivariate application.
