摘 要:公共服务内容及其体系的界定是进行公共服务立法的前提,而公共服务的不同意义层次决定了公共服务的具体内容及体系。按照服务的对象来分,其意义主要有个人意义、社会意义和变迁意义三个方面。它们分别决定公共服务内容,其体系涵盖基础性公共服务、调适性公共服务和演化性公共服务三个方面,每一个方面都涵盖有具体内容和制度要求;并重构了一个新的公共服务内容体系,明晰了公共服务的功能、使命和立法要求。因此,深入回答了公共服务立法的内容体系如何构建,公共服务供给增加与社会持续发展,公共服务职能如何可以和可能统摄经济调节、市场监管和社会管理的政府职能等一些理论和实践难题,以为我国的公共服务立法提供新的视角和参考。The definition of the content and system of public service is a premise for the legislation on it, while the dif- ferent levels of significance of public service determines its concrete content and system. In terms of the objects of public service, its significance consists of individual, social and transitional significance. They determine the three aspects which the content and system of public service must cover, namely, basic public service, adjusted public service and evolutionary public service. Each aspect has its own content and institutional requirements. This reconstructs a new content system of public service, clarifying its functions, missions and legislative needs. Viewed from this angle, many theoretical and practical questions are solved including the construction of the content system of legislation on public service, the increase of the provision of public service relative to sustainable development of society, the overseeing of economic adjustment, market supervision and social management by the function of public service, etc. All these help provide new perspectives and references for legislation on public service.
