摘　　要：病历是医疗活动全过程的客观记录,在发生与处理医疗纠纷时,病历是判定医患双方责任的重要法律依据。与传统纸质病历相比,电子病历作为一种新兴形式,法律效力问题不容回避。电子病历要同时满足真实性、合法性、关联性才能成为证据,这需要从加快制度建设、采用先进技术、加强宣传等方面不断加以完善。Medical record is the objective record in the entire medical process. When dealing with medical disputes, the medical re- cord is the important legal paper to judge the responsibility of hospital or patient. Compared with the traditional paper record, elec- tronic medical record encountered the legal authentication in China as a newly--emerged form. Electronic medical records could be evidence simultaneously meeting the needs of authenticity, legality and relevance, which need to be consummated continually in speeding up the system construction, adopting advanced technology, strengthening public education.
