美国航天产品贸易管控法律制度探析

摘　　要：美国的航天产品贸易在商务部管控时期仅列入"商品管控清单",相对还比较宽松,纳入《国际武器贸易条例》进行管控之后,对其管控范围、出口登记、申请制度、审批程序、审批政策以及违规责任等都作出了相对严苛的规定,加之国际贸易管控的各项压力,一度造成了美国航天产品国际贸易份额的严重下滑。中国必须以此为鉴,进一步规范军民两用产品贸易、优化操作程序和保密管理、建立健全贸易管控机构、加快管控标准立法,努力实现对于我国航天产品贸易的有效管控。The American space products trade in the ministry of commerce control only included in the period of ＂commodity control list＂ ,which was relatively more comfortable. When it entered into the international arms trade regulations on control, the control range, export registration, application sys- tem, examination and approval procedures for examination and approval, policies and illegal responsibility of all made the relatively tough regulation. Since the pressare of international trade control ,the United States space products trade share serious decline. China must aims to establish and perfect the relevant control system, and then try to realize our country ＇ s aerospace products trade for the effective control.
