摘 要:《京都议定书》对于附录1国家提出的强制减排义务催生了以二氧化碳排放权为主的碳排放交易市场,由于"清洁发展机制"(CDM)的开发,中国也不可避免地卷入全球碳交易市场。中国低碳经济的发展以及巨大的国际减排压力,使得中国有必要建立本国的碳排放交易市场。但是中国目前面临着诸多的现实障碍与法律困境,摆脱困境的对策是我国碳排放市场的构建要与我国承担的国际义务以及应对气候变化的立场与承诺相适应,在承担强制性减排义务之前,我国以自愿性减排为主,不宜出台强制性减排的立法,应通过法律机制的引导作用逐渐构建和完善自愿性碳排放交易市场。Mandatory emission reduction obligations of Annex I Countries in the Kyoto Protocol has given birth to carbon emissions trading market specializing in carbon dioxide emissions. Due to the development of Clean Devel- opment Mechanism ( CDM), China inevitably becomes involved in global carbon trading markets. The development of low-carbon economy and enormous international pressure to reduce emissions also necessitates the establishment of a national carbon emissions trading market in China. However, China is faced with many practical obstacles and legal difficulties in this aspect. The solution is that China' s carbon emissions market should be consistent with its international obligations as well as its position and commitment to address climate change. Before taking up mandatory emission reduction obligations, China' s emission reduction should basically be voluntary and China should not introduce mandatory emission reduction legislation. In addition, China should gradually build and improve the voluntary carbon market through the guidance of legislation.
