摘　　要：纸币本质上是国家与货币持有者之间的契约,纸币持有者的财产权利是一种债权权利,其权利价值取决于国家信用的承诺和保证而不是纸币本身"物"的价值。货币发行垄断地位以及契约双方主体之间信息不对称的特点,诱发政府滥用货币定价权的道德风险,政府货币权力不当运用会引发货币持有主体的各种规避策略,最终损害实体经济的运行。为建立一国政府对货币价值的有效承诺和保证,需要将政府权力运行纳入到法治轨道中来,对政府货币权力运行实施有效约束和规范。Considering that paper currency in essence is a contract between the country and the currency holders,property rights of paper currency holders are the rights of credit,whose value are decided by the commitment of a country's credibility instead of by paper currency itself.The moral hazard by the government's abuse of currency pricing is triggered by note issue monopoly and asymmetric information between the two major parties of the contract.The improper use of its authority upon currency by the government may induce the currency holders to adopt various avoidance strategies and ultimately does harm to the operation of entity economy.To ensure an effective commitment of a government upon its currency value,it is needed to regulate the government's authority with laws and regulations.
