摘　　要：社区刑罚的根据应当是报应论限制和制约下的以教育刑论为核心的综合论。具体说来,社区刑罚应当以报应论为基本的规诫,以满足正义和秩序的要求;社区刑罚应当以教育刑论为核心规诫,以满足矫正犯罪人的要求;社区刑罚应当适当考虑剥夺犯罪能力论的要求,以争取社区群众的支持。the basis of community penalty ought to be merge theory which is restricted by retribution the- ory and takes education corporal punishment theory as core. Community penalty ought to think retribu- tion theory as fundamental advises with the demand to meet justice and sequence; community penalty ought to think education corporal punishment theory as core advises with the demand to meet criminal correction ; community penalty ought to slightly meet incapacitation theory to fight for support of com- munity mass.
