摘　　要：我国农民家庭土地承包经营权权能在稳定的基础上不断完善,更多权利已经并应进一步赋予农民。土地承包经营权的占有权、使用权、收益权已经赋予农民,但这三项权利需要强化;处分权应明确其权利客体为土地承包经营权,区分物权性流转和债权性流转;请求权(承包地返还、承包地妨害排除与妨害防止、足额承包地重大妨害补偿与征收补偿)应引起足够重视。Rural famers＇ land contract management right has been continually perfect on the basis of stability in China. More rights have been given to famers. Although the rights of possession, utilization and earnings of land contract management have been given famers, the three rights should be strengthened; the right object of disposal right should be clarified as land contract management right, and property transfer and credit transfer should be distinguished; rights of claim should be put great attention including returning of contracted land, preventing and excluding impairment of contracted land, compensation of important impairment and compensation expropriating.
