摘　　要：气候变化背景下,我国碳交易的市场化在当前面临较多的瓶颈约束和政策风险。基于对我国碳交易发展基本态势和制约因素的考察,分析了碳交易标的的法律属性、交易环节,以及构建碳交易法律促导机制的价值和作用,揭示碳交易市场运行机制与碳交易法律促导机制的内在统一性;指出:顺应我国节能减排政策与策略实施对碳交易市场化的法律需求,发挥法律在碳交易市场创建、交易规则形成、市场规模扩张、交易平台构建、交易形式创新等方面的制度优势,是构建我国碳交易促导的法律机制、突破碳交易市场化瓶颈约束和降低政策风险的有效途径。在此基础上,提出迎合碳减排交易机制对市场创造、技术保障、物质保障、制度保障、配额登记与交易注册平台建设和碳权保护的立法需求,构建我国促进和引导碳交易市场化发展的法律机制的建议和思考。China＇ s current carbon trading market is faced with multiple bottlenecks in the context of climate change. Based on the research on the trends of carbon trading and constraints of the carbon market, the study analyzes the legal attitude of the subjects and the process of carbon trading. Then, it points out that the values and roles of the legal facilitating mechanism should realize the unity of the carbon trading mechanism and the legal facilitating mechanism of the carbon market. Due to the huge advantages of the law in forming rules of carbon emission trading and expanding the demands of the credits for carbon emissions reduction, it is necessary for us to establish legal mechanisms to accelerate carbon transaction and crack the bottlenecks of carbon ETs. The legal facilitating mechanism includes the rules for creating the carbon market, enlarging the market size, building the trading platform, and innovating transaction models, etc. Based on the judgment of legal facilitating mechanism for carbon ETs, the research identifies the legal process in creating the carbon trading market, technical guarantee, institutional guarantee, physical security of carbon ETs, and the property attributes of carbon. The legal advice of this research is of significant theoretical values and practical meaning.
