摘　　要：《刑法修正案(八)》对累犯制度作了较大的修改,规定了未满十八周岁的人不构成累犯,扩大了特殊累犯的成立范围,对判处死缓的累犯限制减刑,这一修改集中体现了宽严相济的刑事政策,体现了与国际社会刑事立法的接轨,刑法立法应适度限定特殊累犯的成立范围,排除老年人构成累犯,将毒品犯罪纳入特别累犯的范围,增设单位累犯制度。The amendment of criminal law （8）made bigger modification on a recidivist system, it makes the provisions of persons under the age of 18 does not constitute a recidivist; expands the scope of the special recidivist, gives limit of sentenced to recidivist commuted death; the modification embodies the criminal policy of tempering justrce with mercy, and embodies the criminal legislation and international society of the world, the criminal law legislation should moderate limit the establishment of special recidivist range, eliminate the oid constitute a recidi- vist, drug crime will be included in the scope of the Special recidivist, and set up the unit system of recidivism
