摘 要:"摊贩现象"兼有积极和消极效应,属于一项争议性政策议题。这种属性深刻影响摊贩监管政策制定及其实施。同时,摊贩问题亦是城市治理中一项边缘性议题,因此,摊贩治理可归属于城市政府"边缘性治理"的范畴。纵览全球,依据"制度化包容程度"和"政策稳定性程度"两种标准,可将城市政府摊贩监管这种"边缘性治理"实践划分为以下几种具有典范意义的模式,即"策略化治理""政治化治理"和"规则化治理",等等。在城市政府中,这些摊贩治理之道受制于一系列特定因素或变量,在政策工具使用上亦各有侧重。The street vending policy can be broadly regarded as a kind of regulatory policy. Because street vending is a highly contentious policy issue, which has both positive and negative effects, this attribute ineradicablely constraints the regulation of street vending. Furthermore, this issue is a marginalized policy issue of the city government. As a result, the regulation of street vending can be classified into the category of 'The Governing of Marginality'. The ways of the governing of street vending by the city government can be categorized into three models, including 'tactic-based governing', 'politicalized governing' and 'rule-based governing', according to twofold criteria (the institutionalized tolerance of the street vending,and the stability of the regulatory policy). In practice, each model not only is affected by different variables, but also relies on some special policy instrument as well as instrument mixes.
