大学生自杀的法律责任分析

摘　　要：大学生自杀是高校无法避免的现实问题之一。本文通过对大学生自杀原因的分析,并在理顺高校与在校大学生法律关系的前提下,对在校大学生自杀案件中高校是否承担责任以及承担什么责任进行探讨。将高校在大学生自杀事件中的责任归属划分为不承担法律责任、承担民事责任、承担连带民事责任和行政责任以及基于人道主义原则所应承担的责任等几种情形,并在此基础上,明确高校和在校大学生各自的责任归属,为避免大学生自杀提出建议。College students＇ suicide is one of the inevitable realistic subjects.In this article,there will be an analysis on the reason of the college students＇ suicide based on straightening out the legal relation between students and university.Further,that whether the university should tale the responsibility and what kind of responsibility it is will be discussed.The responsibility of university in the case of students＇ suicide can be considered into towr kinds,which are bearing no legal responsibility,bearing civil liability,bearing joint civil liability and administrative responsibility,bearing the responsibility based on humanitarian principle.Based on all the analysis above,the responsibility of students and university will be clearly stated and some advises will be proposed to avoid the college students＇ suicide.
