摘　　要：本文从旅游基本法的必要性、形式、性质等方面,分别从旅游的本质、旅游业的发展和旅游的社会及环境问题等角度对我国旅游基本法的模式和基本性质争议进行剖析,最后提出了中国旅游基本法的基本原则:①促进旅游事业的发展;②保障旅游相关主体的合法权益;③合理开发和保护旅游资源;④科学管理旅游业。本文希冀通过对旅游基本法的剖析对旅游基本法在立法必要性上、立法模式上以及立法原则上有更进一步的认识,以起到抛砖引玉之作用。The main theme of this thesis is Tourism Basic Law in China.In this paper,four important points are contained.The first point tries to prove the necessity of Tourism Basic Law,while the other three points study on the nature and content.The first part is mainly about the essential necessity of Tourism Basic Law,which serves for the needs of the development of tourism.The second part reviews the patterns of the Tourism Basic Law.The third part studies on the character of Tourism Basic Law.In part four,the writer＇s viewpoints about the four principals of Tourism Basic Law.First,promote the development of tourism.Second,guarantee tourism stakeholders＇ rights.Third,reasonably exploit and protect the tourism resources.Fourth,make scientific management on tourism industry.
