摘　　要：侵权责任一般条款与法律原则、具体条款是不同的,它具有概括性、开放性、兜底规范性、价值补充性等特点;具有作为一切请求权的基础(只有一般条款时)、适应社会的发展、保持法律的简洁、保证法律的逻辑自足等功能。The general conditions and terms of liability for tort differ from the specific ones. It is general,open,bottom line standardability,and value complementariness in character. In terms of function, it is the base for all rights of claim （when only general conditions and terms） ,adaptable to social development,and ensuring the succinctness of law as well as the self sufficiency of law in logic.
