论滥用职权罪中“重大损失”的体系地位

摘　　要："重大损失"是滥用职权罪的危害结果,应属于主观认识内容。认为其属于罪量要素、限制处罚范围的事由、客观处罚条件或者客观的超过要素都是不当的。我国对该罪设置了7年以下有期徒刑的法定刑,是基于该罪的客观行为样态等考虑,符合我国刑法的基本理论。＂Heavy losses＂ is the harm results of the crime of abuse the power and position,should belong to the subjective understanding intent.The opinion that holds it to be the elements of quantity of crime,condition for limit the punishment rang,objective punishment condition or exceeding—intent practical element is inappropriate.As for thus cause statutory punishment seemingly uncoordinated,it is because of the ignoring the objective behavior structure of the crime,which leads to the inappropriate conclusions.
