司法人员职务犯罪“以事立案”模式研究

摘　　要：司法人员职务犯罪案件是一种典型的立案难、侦破难、取证难的"三难"案件。该类犯罪案件因其多数罪名都是结果犯,犯罪事实容易暴露,但该类犯罪责任分散,犯罪嫌疑人不易锁定。针对这些特点,检察机关应转变传统的单纯"以人立案"的做法,积极探索"以事立案"模式,切实确立"以事立案"为主,"以人立案"为辅的综合立案模式。"以事立案"模式是提高侦查效率、降低办案风险的内在要求,是促进侦查模式从"由供到证"向"由证到供"转变的关键。运用"以事立案"要确立一条立案原则、把握两个立案条件和掌握三种立案技巧。The case of judicial personnel＇s occupational crime is a kind of difficult case of filing,detect and attaining evidence.Most of crime counts of this type of crime belong to consequential offense with features of exposure easily of crime fact and ascertain difficultly of crime suspect because of distraction of duty.For above-mentioned features,the procuratorate should change the traditional and single mode of filing based on suspect,and probe actively the mode of filing based on matter,it is better to combine the two modes in order to establish the final filing mode that the mode of filing based on matter is first,the model of filing based on suspect is second.Filed basing on matter is an inherent requirement of enhancing the investigating efficiency and reducing risk of handle-case.It is the key to promote the investigating mode changing from the mode of ＂from statement to proof＂ to the mode of ＂from proof to statement＂.It is necessary to establish one principle of filing,assuring two conditions of filing and commanding three filing skills for applying efficiently the mode of filing based on matter.
