构建可适用于图书馆的著作权例外研究的基本理论体系

摘　　要：从有利于图书馆维护自身合法权益、规避著作权侵权风险、为公众提供更高效服务等角度出发,提出研究图书馆可适用的著作权例外的基本理论体系的必要性。结合可适用于图书馆的著作权例外的立法原理、发展趋向、当前立法、图书馆信息资源建设和信息服务活动,建构图书馆可适用的著作权例外的基本理论体系的十项基本内容,指出开展这方面研究的基本思路和重点难点。有关可适用于图书馆的著作权例外的研究,其实际意义和应用价值最终关系到公众的信息获取和人类知识的广泛传播与有效利用。Building theory architecture of study on copyright exceptions applicable to library world is essential, for it can safe- guard the legitimate rights and interests of libraries, help libraries to avoid the risk of copyright infringement, provide more satisfactory services for the public with the maximum benefit. On this basis, combining with eotSyright law, trends, legislative situation of copyright exceptions applicable to library world, as well as the ongoing information resource and information serv- ices in library world, the article built theory architecture of study on copyright exceptions applicable to library world including ten items, pointing out basic ideas and key points to conduct research in this area. In fact, practical significance and value of study on copyright exceptions applicable to library world, is ultimately related to public information access and dissemination of human knowledge and its effective use.
