摘 要:我国《政府采购法》明确规定政府采购应当扶持少数民族地区,但目前尚未出台相关的政策措施。因此,遵循WTO规定并借鉴国外做法,应当为少数民族地区企业预留政府采购合同金额和实施采购价格优惠。同时,为确保政府采购的优惠扶持措施为"少数民族地区的企业"所"专享",应该将相关优惠对象严格界定为"少数民族地区企业原产地资格的本国货物"。Government Procurement Law in China clearly stipulates that government procurement should fulfill the function of supporting the development of ethnic minority areas,however,no specific policies or measures have been promulgated so far.Therefore,in compliance with WTO rules and referring to the experiences of other WTO members,two different measures should be applied to improve our policy making:one is reserving a certain percent of all procurement contracts for enterprises located in ethnic areas;another is offering price preferences.In addition,it is quite necessary to ensure that these preferential policies and measures are granted exclusively to enterprises located in ethnic areas.Thus,we suggest to strictly confine the scope of targeted goods under these preferential policies as"domestic goods with origin of ethnic minority areas,produced by enterprises located in ethnic minority areas."
