关于秦与汉初“入钱缿中”律的几个问题

摘　　要：出土简册中有秦与汉初"入钱缿中"律的内容。律文中"为作务"是与"官"或"官府"类似的概念,钱是损坏公物后依价赔偿的钱款,质钱是官府为大型交易提供质剂而收取的税金,所涉及的款项只是地方官府收入的一部分。此律可能同时出现于秦律《关市》、《金布》中,在秦统一前后律文可能作过修订。In the texts of the Shuihudi Qin Bamboo Slips, Zhangjiashan Han Bamboo Slips and Yuelu Academy Qin Bamboo Slips, the contents related to the ＂ru qian xiang zhong 入钱垢中（entering cash in the money-box）＂ in the statutes are preserved. The term ＂wei zuowu 为作务＇ in the article had similar meaning to the ＂official＂ or ＂government＂; ＂ziqian 齐钱 was the redemption fee paid for the damaged government properties, and ＂zhiqian ）质钱＂ was the tax levied by the government as the mort- gage for large-scale trades. The money mentioned in this article was just a part of the revenue of the local government, which was transferred to the county government; the portion of the ＂zu 租（grain tax）, zhi ）质（trade mortgage）, household tax and the taxes of gardens and ponds＂ in the levied taxes by the county government might be appropriated by the central government to the imperial court. This article might have appeared simultaneously in the Guanshi Lii （Statutes on Passes and Markets） and Jinbu Lii （Statute on Currency） of the Qin State, and might have been edited around the unifying of the Qin Dynasty.
