全国单项体育协会自治困境与对策研究

摘　　要：依照《体育法》(1995)与《社会团体登记管理条例》(1998),全国单项体育协会已获得独立法人资格,并依法拥有排他性管理本协会内部事务的自治权力。然而该自治权在全国单项体育协会实际运作中并未如实体现。审视全国单项体育协会的形成路径、内部组织结构设置及其与运动项目管理中心的关系,从实然角度探析其自治态势,发现:现实中的全国单项体育协会自治存在制度性、观念性、人文性障碍,而并未取得实质性自治。以中国足球协会为例,分析了全国单项体育协会在依法推行其自治进程中存在的内外部困境及其原因,并提出改进意见与立法建议。At present, the state law defines National Association of Single Sports as an association with independent legal personality, but self - governing in sports industry is not well implemented in practice. This paper examines the formation of National Association of Single Sports, its infrastructure and relationship with State Sports Administration in an attempt to reveal its state of self - governing. It is found that in reality self - governing in sports industry are faced with institutional, conceptual and cultural obstacles so that it has not gained substantial self- governing yet. It further analyzes the internal and external difficulties in implementing self- governing in sports industry and their causes, and then puts forward some suggestions on improvement and legislation.
