摘  要:针对反腐败过程中出现的新情况、新问题,很有必要借鉴、学习国外防止利益冲突在立法方面的成功经验。本文从公务员利益冲突涉及的回避制度、兼职取酬制度、财产申报制度、禁止收受贿赂制度、岗位轮换制度、离职后的行为限制等主要方面进行了中外防止公务员利益冲突的制度比较。本文认为,借鉴发达国家在防止公务员利益冲突上的法律法规,可以弥补我国在防止公务员利益冲突方面的不足,从而使我国防止公务员利益冲突制度更加科学化和规范化。At present,the conflict of interests at all levels civil servants in our country has become the important reasons for corruption.Because of the new problems of the anti-corruption,it is necessary to learn the effective way to prevent the conflicts of interest from other countries.This paper makes a comparison of the main aspects of the interest conflict of civil servant between China and foreign countries.The main aspects include challenge system,part-time reward system,property declaration system,prohibit bribery system,Job rotation system,limit behavior after leaving,ect.Through the comparison,we can use some effective ways to prevent the conflicts of interest in civil servant from other developed countries for conference.In order to make up the shortage of prevent conflicts of interests in civil servant and promote the scientific and standardization to prevent conflicts of interest of civil service system in our country.
