关于计划生育村民自治的几个问题

摘　　要：对计划生育村民自治的几个问题进行了探讨。生育与节育本属于个人私事,且在计划生育问题上很难形成共同利益,因而生育与节育不属于自治范畴。目前计划生育村民自治中的某些做法有违宪法精神,自治变"治民"而非"民治",自治变"人治"而非"法治",自治变"管理"而非"服务",自治变"制约"而非"激励"的现象在全国各地都不同程度地存在。This paper probes into several issues concerning family planning villagers＇ ernance. It explicitly points out that procreation and contraception do not belong to ernance in that, on one hand, they are personal affairs; on the other hand, common difficult to achieve on family planning issue. Currently, some behaviors among those serf - gov- self - gov- interest is villagers self - governance, being of great presence to various degrees in whole China, go against Consti- tution, converting self - governance into ＂governing people＂ instead of ＂people governing＂ ; into ＂people ruling＂ rather than ＂law ruling＂ ; into ＂governing＂ as opposed to ＂serving＂ ; into ＂restricting＂ over ＂motivating＂.
