我国预付式消费模式的法律规制

摘　　要：预付式消费模式的兴起具有现实基础,但也存在扰乱金融秩序、侵害消费者利益、扩张负面功能等问题,故应对其予以法律规制。各国关于预付式消费模式的法律规制有以下共同点:通过对预付卡的监管来规制预付式消费;公法和私法两种手段并用;发挥自律组织的积极作用。我国应在借鉴各国规制经验的情况下,根据预付式消费实践及国情,建立富有针对性的规制模式。然而,我国相关法律、法规及规章等规范性文件,存在层次较低、规制不全面、实施效果差等缺陷。因此,应对我国预付式消费模式的法律规制作全新的制度建构,其主要内容包括:设立预付卡发行制度,设立预付卡实名登记制度,设立严格的监管制度,制定全国性合同示范文本。The rise of prepayment consumption has actual basis. There also have some problems such as disrupting the financial order, damaging consumer interests, expanding the negative function. So the pre -payment consumption should be legal regulated. There are some common points among the legal regulation of prepayment consumption in various coun- tries as follows： regulating the prepayment consumption by supervising and controlling prepaid card, combing the regulation methods including public law and civil law and playing the positive role of self - discipline organization. By using the expe- rience of other countries for reference, in our country the target - oriented regulation mode should be established in accord- ance with the practices and eountry~ traditions of prepayment consumption. However, concerning laws, regulations, rules and other regular documents in China have defects such as low lever, incomplete regulation and poor implementing effect. Therefore, the legal regulation of prepayment consumption should be made institutional construction. The main contents in- clude establishing the prepaid card issue system, the real -name registration system, the strict supervisory system and for- mulating the national demonstrative text of contract.
