摘　　要：目的:明晰公立医院的公法人地位与属性,进而采用相应的治理结构改革策略。方法:应用文献分析法对公法人制度的概念内涵和我国公立医院具有"公法人"属性进行对比研究。结果:提供基本医疗服务的医疗机构具有公法人属性。结论:医院治理结构改革引入"公法人"制度是必要的,改革中应将治理目标集中在解决医疗服务的公平问题上。Objective： To identify whether public hospital belongs to the legal person of public law and to take measures to reform the governance structure of public hospitals. Methods： The methods of documentary analysis were used to study the concept of public law person syslem and status of legal person of public hospitals. Results： Public hospitals in charge of providing basic medical service to everyone equally belong the legal person of public law. Conclusions： The studies suggest that it is necessary to reform governance structure of public hospitals according to the public law person system.
