摘 要:临时仲裁制度由于其高度的灵活性和赋予当事人充分的意思自治的权利,已为很多国家所认可和接受。目前,我国各界关于引入临时仲裁的呼声也很高。本文通过对临时仲裁与机构仲裁的比较研究,阐述了两者各自的优势和问题,同时归纳目前学界比较盛行的引入临时仲裁的主流论点并指出其存在的问题,认为目前我国引入临时仲裁的时机并不成熟。引入临时仲裁的时间取决于在人、制度和理念问题上首先得以突破。Starting with the comparison between Ad hoc arbitration and institutional arbitration, this article indicates Ad hoe arbitration has advantage of party autonomy and full flexibility while the institutional arbitration excels in procedural certainty and case management. It also discusses several controversial issues such as fees, efficiency and fairness. Subsequently it focuses on whether China should introduce Ad hoc arbitration and of the view that, despite of the mainstream opinions, it is premature to introduce Ad hoc arbitration in China. Finally it analyzes the momentum of when it is appropriate to encourage Ad hoc arbitration in China. As a conclusion, Ad hoc arbitration has its in- comparable advantage in terms of full party autonomy and should be permitted in the long term while the timing relies on formation of qualified arbitrator circle, breakthrough of the arbitration system and a society of good credibility.
