摘　　要：法国担保法改革在《法国民法典》中引入了"安慰函"的概念,丰富了大陆法系国家有关"人的担保"的立法。法国法因此树立了一个范例,其有关"安慰函"的定义、判定、签发人的担保义务的识别、"安慰函"与"保证"和"独立担保"等传统"人的担保"类型之间关系的厘清,无论在理论上、立法上还是实务上都具有重要的比较法意义。French guarantee law reform introduced in the French Civil Code the concept of ＂Console letter＂, which enriches ＂personal security＂ legislation of the civil law countries. French law therefore sets an example. Concerning the definition and determination of ＂console letter,＂ identification of guarantee obligations issued from the letter, and clarification of relationship between the ＂Console letter＂ and the other kinds of ＂personal securities,＂ such as ＂guarantee＂ or ＂independent guarantee. ＂ French law has an important significance of comparative law, both in theory or legislation and on practice.
