植物品种权扩张背景下“农民特权”的法律保护

摘　　要：农民特权的正当性在于对习惯的尊重、维持农民生计和保护粮食安全的需要,但植物品种权的扩张造成农民特权被合同架空、被技术措施扼杀、被国际公约限制等现实困境,我国应从扩大权利范围、廓清权利主体、规制技术措施和慎待国际公约几个方面完善农民特权的法律保护。The legitimacy of farmers＇privilege lies in the respect for customs, the maintenance of farmers＇ livelihood and the need for food security. With the expansion of plant variety rights, farmer＇s privilege is made unpractical by contracts, snuffed by technical measures and restricted by international treaties. The legal protection of farmers＇ privilege should be improved.
