我国低碳经济法规存在的问题及其应对机制

摘　　要：发展低碳经济离不开法律的推进和保障。当前,我国已经制定了一系列开展低碳经济的法律法规,但是还存在诸多问题,不能有效推进低碳经济的发展,具体表现为:低碳经济基本法缺位、重点领域立法空白、现有法律规定缺乏操作性、基本制度缺失、激励手段不足以及监督执法力度有限等弊病。下一步低碳经济法律应围绕以下几个方面进行完善:尽快出台统领低碳经济的基本法、启动碳排放权交易制度、完善低碳财税手段、推进环境信息公开和公众参与机制、强化环境执法。构建低碳经济社会是一项复杂工程,只有在完善的法律保障机制下,多种手段相互配合,才能最终实现经济发展的低碳运行。Low - carbon economy can not develop without law＇ s promotion and safeguard. At present, our country has formulated a se- ries of laws and regulations regarding the development of low - carbon economy, but there are still a series of problems which can not effectively promote the development of low - carbon economy. It displays the absence of low carbon primary law, the blank of legislation in key areas, the deficiency of present laws and regulations operability, the absence of primary system, insufficient motivator, and limited monitoring law enforcement. Next step low- carbon economy law should be improved through centering on following aspects： publish the primary law guiding low - carbon economy as soon as possible, launch the system of carbon emission trade, improve low - carbon taxation, promote environment information openness and public par- ticipation mechanism, and strengthen environment law enforcement. The building of low - carbon economy society is a so- phisticated project so that only if thorough law safeguard mechanism is available and a variety of means interworks, can low - carbon operation of economic development be realized.
