摘 要:关于非法演绎作品,各国版权法多持不保护论,认为它们虽然有原创性,但毕竟属于侵权作品,不受法律保护,演绎作者不享有该作品的版权。非法演绎作品的不保护论,既不利于保护原作者利益,也造成了对演绎作者的不公,是过度保护原作者演绎权的表现。演绎权与演绎作品的版权并不相同,原作者的授权不应成为演绎作品受版权保护的必要条件。为激励演绎作品创作,促进文化繁荣,版权法有必要保护非法演绎作品,肯定原作者和演绎作者在该作品上的双重版权。In copyright acts of many countries, illegal derivative work can not be protected because such a kind of work infringes the author' s derivative rights. Even this work is original and its creator won' t be the owner of copyrights. The theory for not protecting illegal derivative work is not only bad to the original author, but also unfair to the subsequent author, which is the performance of protecting the original author' s derivative rights excessively.Derivative rights is different from copyright of derivative work, and the original author' s authorization isn' t the qualification for the work to be protected. To encourage the creation of derivative work and promote the prosperity of culture, copyright act should protect illegal derivative work , granting the copyright of such work to the original author and the subsequent author.
