摘  要:通过对中国港口经营人责任限制的分析以及对《鹿特丹规则》下海运履约方制度的解读,探讨非承运人委托作业时港口经营人责任界定。得出中国可以借鉴《鹿特丹规则》,通过完善《中华人民共和国海商法》实际承运人制度,使实际承运人适用于港口经营人,可以享有责任限制权,但仅限于消极抗辩权。Based on the introduction of the definition of marine performing party as provided in the new convention of Rotterdam Rules, the paper held that port operators should be assigned as maritime performing party in the new convention under certain conditions. The paper made a deep and completed analysis of the impact of marine performing party system in the new convention on port operators, pointed out that the port operators should be entitled to the right of liability limitation on the basis of the actual carrier system as provided by the Maritime Code of the People's Republic of China but the right shall be confined only to negative right of defense.
