摘　　要：在学理上,非国家工作人员职务犯罪是与国家工作人员职务犯罪相对应的概念,但与作为传统职务犯罪的后者相比它与公共权力的关联度不大,又是我国刑法学上较晚出现的类罪,因此以往人们对其有所忽视。然而,这类犯罪在经济经营领域的危害极大,且常与国家工作人员的腐败密切相关。文章阐述了非国家工作人员职务犯罪的构成特征,通过对其犯罪危害性的实证分析,强调应重视防范,并提出了具体的防范和惩治措施。Theoretically, non-national staff＇s duty crime should have a corresponding concept with the national staff＇s duty crime. However,comparing with the latter,a traditional duty crime,it relates loosely to the public power. In addition,it came much later in China＇ s criminal law so it is often neglected. This type of crime is harmful in the field of economy and closely related to corruption case of the national officials. The constitute features of this crime are described in this paper with proposals for prevention and punishment based on the empirical analysis.
