摘 要:目前,对于海上船员人身伤亡损害赔偿,无论在民事法律还是劳动法律框架下我国都没有特别立法,而适用一般的人身损害赔偿法律、法规和司法解释,又不足以甚至无法解决涉及劳动关系的海上船员人身伤亡这一特殊问题。在此现实下,司法实践中对于赔偿标准、归责原则以及赔偿范围等问题的认识存在较多混乱和矛盾。针对现行法律下涉及劳动关系的船员人身伤亡损害赔偿的法律适用问题,建议赋予受害人选择权,约定赔偿不得低于法定标准,并区分情况分别采用"实际收入"和"平均收入"赔偿标准。Currently there is no legislation in China m either civil law or labor law regarding compensation for personal casualties of crewmembers at sea. Such cases are usually resolved by applying the general law of damage compensation for personal casualties which is inadequate for or even contradictory with the special nature of the disputes over labor relations. In the present context, many confusions and controversies exist in judicial practices concerning the compensation standard and scope as well as principle of liability. Given the complexity of the problem of applicable laws for damage compensation for personal casualties of crewmembcrs involving labor relations, this paper argues that the victim's rights to pursue their claims under different laws or statutory standards should be recognized and the agreed upon compensation should not be below standards set by laws. In addition, actual income and average income should be taken into account in setting the compensation standards.
