论“人肉搜索”刑法规制的必要性和可行性

摘　　要："人肉搜索"作为一种利用人工参与来提纯搜索引擎提供信息的机制,是我国社会转型的产物。近年来,"人肉搜索"虽然在促进言论自由、信息交流和媒体监督等方面具有重要意义,但其引发的问题也日益引起人们的关注。基于此,对"人肉搜索"入刑的必要性和可行性进行分析,旨在刑法体系下对其加以规制,更好地保障个人信息安全,促进社会和谐的发展。Intemet Flesh Search, a mechanism making use of individual participation in verifying information provided by search engines, is a product of social transformation. Nowadays, Intemet Flesh Search has significant influence on promoting freedom of speech, information this paper tries to analyze and media supervision. However, the problems it causes also arouse people＇ s attention. Based on this situation, the necessity and feasibility of including Interact Flesh Search into the Criminal Law, for the purpose of administrating it under the system of the Criminal Law, which can consequently ensure the security of personal information and thus promote more harmonious social development.
