摘　　要：经济发展、社会变迁促使人们权利需求、权利观念的演进,一些新兴的权利开始涌现,社会保障权便是其中一例。从理论和实践两个层面证实社会保障权作为基本权利的权利属性。在此基础上,以宪法解释和宪法修改两方面论述社会保障权宪法化的路径。The economic development and the social change promote the evolution of people＇s right claim and conception of rights. So some of the emerging rights began to emerge, the right to social security is an example. The right attributes of the social security rights as basic rights were confirmed from both theo- retical and practical levels. On this basis, the constitutionalization of social security right is discussed on the two aspects of interDreting and modifying the constitution.
