摘　　要：伴随在华外国公司投资额度和公司数量的急剧增加,在华外国公司犯罪问题日益凸显,而与此相适应的立法、司法和理论研究却严重滞后。以此为背景,我们随机选择了2002年至2011年间100个在华外国公司犯罪的现实案例,在对犯罪规律和趋势进行多视角剖析的基础上,着力思考如何解决在华外国公司犯罪态势高发、社会责任严重缺失的应对问题,对于如何构建与中国经济地位、国际地位相适应的外国公司犯罪的刑事政策,如何强化中国刑事司法对于外国公司犯罪的防治力度进行了尝试性探索。With the rapid increase of the amount of foreign company investment and the number of foreign companies, the crime issues of foreign companies in China are becoming more serious than ever before. How-ever, the legislative, judicial and theoretical researches on these issues are seriously lagging behind. There-fore, on the basis of analyzing crime patterns and trends, this article mainly considers how to solve the issues that foreign companies＇ crimes happen in China frequently and the lack of social responsibility by randomly chooses 100 foreign companies＇ crime cases in China from 2002 to 2011. In addition, this article also explores how to establish a qualified criminal policy in correspond with China＇s economic and international status, and how to strengthen the strength of prevention and cure of Chinese criminal justice for the crimes conducted by the foreign companies in China.
