论旅行社资金门槛的问题与对策——兼议挂靠承包的治理

摘　　要：目前的旅行社资金门槛过高,过度限制了旅行社经营自由,制约了旅行社行业的正常竞争秩序,扭曲了旅游服务供需平衡,最终损害旅游者权益。该资金门槛既不符合大多数国家的做法,也不符合行政法上的比例原则。应及时取消不必要的资金门槛,并通过完善旅行社责任保险制度,鼓励旅行社特许连锁经营等办法,来实现相应的目的以及化解相应的顾虑。The excessive capital threshold for travel agenies imposes huge restrictions on its business operations and competition order of the industry, thus distorting the balance of supply and demand of tourism services and harming the rights and interests of tourists. The practice is not in line with that of most countries and fails to stick to the proportional principles of administrative law. The unnecessary capital threshold should be abandoned in a timely manner and travel agencies can achieve the same results and address relevant issues by improving liability insurance system and encouraging franchising chains.
