摘 要:行政调解作为诉讼外替代性纠纷解决机制(ADR)的重要组成部分,对定纷止息、构建和谐社会有着显著的实践意义。然而,由于依法达成的行政调解协议不具备强制执行力,产生了权利人诉累增加、义务人违约成本低廉、行政资源和司法资源的双重浪费、行政机关专业技术优势无法发挥等问题,导致行政调解的优势难以发挥。鉴于此,首先应从效力位阶、政治传统、文化传统的视角分析行政调解协议的应然效力,然后就赋予行政调解协议强制执行力提出若干制度保障意见和程序建议。As an important part of Alternative Dispute Resolution,administrative mediation is of crucial importance to subside conflicts and construct a harmonious society.However,because of a lack of executive power in administrative mediation agreements,many problems have emerged such as increased burden for the obligee,low cost for the obligor to break a contract,double waste in administrative and judicial resource,and inadequate use of professional strength in administrative offices,etc.Therefore,the advantages of administrative mediation can not be brought into full play.In view of this,it should first analyze the due power of administrative mediation agreements from the directions of effect stratum,political and cultural traditions,and then put forward several suggestions of system protection and procedures for the authorization of executive power to administrative mediation agreements.
