摘　　要：从法定的可适用于图书馆的著作权例外、从图书馆面临的数字化网络化环境和从图书馆当前的资源建设与信息服务等三个角度,分析从图书馆可适用的著作权例外角度规避著作权侵权风险的可行性。在此基础上,将我国图书馆规避著作权侵权风险的对策建议分为两大方面。一是严格遵循并充分利用可适用于图书馆的著作权例外,包括:图书馆从复制权例外角度开展数字资源长期保存的对策;图书馆从信息网络传播权例外角度规避著作权侵权风险的对策;图书馆从技术措施规避例外角度规避著作权侵权风险的对策;充分利用可适用于图书馆的声明性著作权例外的对策。二是不作被动地等待,而是主动参与、积极宣传和专门跟踪。包括:积极反映著作权例外立法诉求,参与立法活动;加强可适用于图书馆的著作权例外的宣传推广;设置著作权研究部门或专职研究岗位。From the perspectives of statutory copyright exceptions applicable to library world, digital and networked environment that libraries faced, and the current information resources construction and information service provision of library, the article analyzed the suggestions on the feasibility of avoiding copyright infringement based on copyright exceptions applicable to library world. On this basis, the proposals for library world to avoid copyright infringement are divided into two areas： Firstly, making full use of copyright exceptions applicable to library world, which includes： tactics based on the exceptions to the right of reproduction that are applicable to libraries; tactics based on the exceptions to the right of communication through information network that are applicable to li- braries; tactics based on the exceptions to circumvention of technological measures to circumvent that are applicable to libraries and tactics based on Creative Commons. Secondly, to library, there is no a passive waiting, but active participation, positive publicity and special track, which includes： positive reflection on the demands of copyright exceptions legislation and participation in legislative activities, strength of the publicity and promotion of copyright exceptions applicable to library world and full -time research posts for copyright research.
