摘 要:当前我国教育救济制度中,高校申诉规定较为笼统和原则、诉讼规定不明确、仲裁规则未建立,致使受教育权的申诉救济缺乏实效性,大量受教育权纠纷无法通过诉讼和仲裁渠道来解决。为了健全教育救济制度,我国应在法律至上、制度完备、正当程序、规则公平、权力制约和权利保障的法治原则指导下,完善高校申诉规定,拓展教育诉讼范围,引入教育仲裁方式,将受教育权纠纷纳入诉讼与仲裁的受案和审理范围,并细化相关制度条款。这有利于高校学生受教育权获得充分、有效、及时的法律救济与保护。In the current Chinese education relief system, the provisions of college complaint mechanism are rather general; and the principles and the rules of litigation are ambiguous as well; besides, the arbitration rules are not established. These phenomena result in the lack of effectiveness of the education relief system concerning the fight to education and lead to the inaccessibility of a large number of disputes with regard to fight to education to be solved by litigation and arbitration. In order to establish a sound education relief system, our country, under the guidance of the rules of law which are the supremacy of law, complete system, due process, fair rules, power restriction and right protection, should perfect the college complaint regulations, expand the range of education litigation, introduce education arbitration, incorporate the disputes with respect to the fight to education into case handling and hearing range, and refine the corresponding terms. These countermeasures are conducive to providing full, effective and timely legal remedies and protections for college students' fight to education.
