从确立保存到传承复兴的“非遗”国际法保护之路——评析国际“最佳实践项目名录”制度

摘　　要："最佳实践项目名录"因其重视教育传承和复兴文化价值的特性,成为联合国教科文组织对非物质文化遗产保护的最重要措施之一。我国需适应国际非物质文化遗产保护的新趋势,根据"最佳实践项目名录"的评审实质标准、设立目的价值以及他国成功入选"最佳实践项目名录"的经验,按照弘扬复兴、教育传承、打破地域界限的非物质文化遗产国际合作实践的模式完善法律制度,实现成功入选"最佳实践项目名录"的目标。The List of Register of Best Safeguarding Practices is regarded as one of significant protection measures for intangible cultural heritage （ICH） in UNESCO, mainly because its characteristics of educational heritage and the value revival. China needs to follow the new trend for ICH international protection to apply for the List of Register of Best Safeguarding Practices, which should clarify the List of register of best safeguarding Practice＇s review substantial criteria, purpose of the value, and summary of the basic purpose of international legal protection of other state pro-jects which are successfully approved by the General Assembly. Finally China can improve the legal system to be in the List of Register of Best Safeguarding Practices in the future by accepting the ICH international protection model, such as promoting revival, educating heritage and enhancing international cooperation.
